DURING A PANDEMIC CITIZENS SEEK LEGAL ASSISTANCE FROM CIVIL SOCIETY ORGANIZATIONS

ВО ВРЕМЕ НА ПАНДЕМИЈА ГРАЃАНИТЕ БАРААТ ПРАВНА ПОМОШ ОД ГРАЃАНСКИТЕ ОРГАНИЗАЦИИ

 

Пандемијата предизвикана од КОВИД-19 на граѓаните од ранливите групи дополнително им го отежна пристапот до правдата и пристапот до институциите, поради што сè поголем број граѓани се обраќаат до здруженијата за обезбедување бесплатна правна и параправна помош.

Во изминативе 11 месеци, откако почна да се имплементира проектот „Пристап до правда за најмаргинализираните“, повеќе од 1.000 граѓани од ранливите групи се обратиле кај граѓанските организации и побарале правна и параправна помош. Правната помош се обезбедува од правници, додека параправната помош се обезбедува на терен, од страна на параправници, кои се дел од заедниците што ги претставуваат и се обучени и имаат знаења за обезбедување помош и советување.

Здружението ХОПС – Опции за здрав живот Скопје обезбедува бесплатна правна и параправна помош за сексуалните работници и работнички, за лицата кои употребуваат дроги, како и за нивните семејства. Од март 2020 година, ХОПС е овластено здружение за обезбедување примарна бесплатна правна помош на сите граѓани, кое покрај правно советување, им овозможува да поднесат барање за бесплатен адвокат до Министерството за правда. 

Здружението за правна едукација и транспарентност – Станица П.Е.Т. од Прилеп обезбеди 752 услуги за семејствата во социјален ризик, лицата од ромската заедница и од руралните средини. Здружението обезбедува правни насоки и асистенција преку своите правници и параправници кои работат на територијата на Прилеп и околните рурални места.

Граѓаните најчесто бараат правна помош од областа на социјалната заштита, вработувањето, домувањето и земјоделската дејност, додека кај параправниците се обраќаат за помош во однос на искористувањето на економските мерки за справување со кризата, образованието, здравствената заштита, социјалната заштита и добивањето лична документација.

За лицата кои употребуваат дроги се обезбедени 473 услуги, поврзани со социјалната заштита и економските мерки за поддршка на граѓаните, разводот на бракови, запирањето на течењето на роковите за правни лекови во судските постапки за време на вонредната состојба, дискриминацијата поради зависност, движењето во време на забрана, но и совети за прекршочни и кривични дела. За сексуалните работници е обезбедена правна помош во 1.571 случај, најчесто за заштита од семејно насилство, насилство од страна на клиентите или полицијата, разводи и родителски права, како и за нерегулирани лични документи, економски мерки за поддршка на граѓаните и слично.

Услугите се обезбедуваат со целосно почитување на протоколите и притоа се преземаат мерки за заштита на граѓаните, правниците и параправниците.

DURING A PANDEMIC, CITIZENS SEEK LEGAL ASSISTANCE FROM CIVIL SOCIETY

The pandemic caused by COVID-19 further aggravated the access to justice and access to institutions for the citizens of vulnerable groups, due to which an increasing number of citizens turn to the associations for providing free legal and paralegal assistance.

In the past 11 months, since the implementation of the project “Access to Justice for the Most Marginalized”, more than 1,000 citizens from vulnerable groups have turned to civil society organizations for legal and paralegal assistance. Legal aid is provided by lawyers, while paralegal assistance is provided in the field, by paralegals, who are part of the communities they represent and are trained and have knowledge of providing assistance and counseling.

The HOPS Association – Options for Healthy Living Skopje provides free legal and paralegal assistance to sex workers, drug users and their families. Since March 2020, HOPS has been an authorized association to provide free primary legal aid to all citizens, which, in addition to legal advice, allows them to apply for a free lawyer to the Ministry of Justice.

The Association for Legal Education and Transparency – LET STATION from Prilep provided 752 services for families at social risk, persons from the Roma community and rural areas. The association provides legal guidance and assistance through its lawyers and paralegals working on the territory of Prilep and the surrounding rural areas.

Citizens often seek legal assistance in the field of social protection, employment, housing and agriculture, while paralegals seek help in using the economic measures to deal with the crisis, education, health care, social protection and obtaining personal documentation.

473 services are provided for drug users, related to social protection and economic measures to support citizens, divorce, suspension of legal remedies in court proceedings during a state of emergency, discrimination due to addiction, movement in time of prohibition, but also advice on misdemeanors and crimes. Sex workers were provided with legal assistance in 1,571 cases, most often for protection from domestic violence, violence by clients or the police, divorce and parental rights, as well as unregulated personal documents, economic measures to support citizens and the like.

The services are provided in full compliance with the protocols and measures are taken to protect citizens, lawyers and paralegals.
