Online training for Promotion of the new Law on prevention and protection from discrimination and CPD

Во периодот од 01-03 септември 2021 година, се одржа активноста: „Промоција на новиот Закон за спречување и заштита од дискриминација и КСЗД во соработка со Мрежата за заштита од дискриминација“, насловена како: „Што и колку знаеме за дискриминацијата“. Целта на активноста беше учесниците да се запознаат со основните поими на дискриминацијата, новиот Закон за спречување и заштита од дискриминација и неговата имплементација, како и механизмите за заштита.

На обуката зедоа учество 18 учесници (параправниците на Станица П.Е.Т., промоторите во заедницата, како и заинтересирани припадници на маргинализирани заедници).

Обуката се одржа онлајн на платформата Zoom, под водство на обучувачките Драгана Дрндаревска и Наташа Бошкова од Коалиција Маргини и Мрежата за заштита од дискриминација.

На првиот ден од обуката, учесниците имаа можност да учат за правото на еднаквост, законски дефиниции за дискриминацијата, основите за заштита од дискриминација и облиците на дискриминација преку анализа на националната правна рамка и дискусија со конкретни примери на дискриминација од секојдневното искуство на учесниците. Исто така, учесниците дискутираа за начините на препознавање на видовите дискриминација (асоцијација по перцепција, повеќекратна, повторена и продолжена/интерсекциска) и спречувањето наспроти заштитата од дискриминација, исклучоци од нееднаквиот третман, како и товарот на докажувањето.

На вториот ден од обуката акцентот беше ставен на разбирањето и препознавањето на интерсекциската дискриминација, при што се обрна посебно внимание на маргинализираните заедници (посебно Ромската заедница и граѓаните кои живеат во рурални средини). Заедно со учесниците беа изведени дефиниции за расната и родовата дискриминација кои се едни од најзастапените и од кои најмногу се засегнати граѓаните. Обучувачката напомена дека често граѓаните имаат проблеми околу препознавањето на овие видови дискриминација, што особено ја доведува во прашање еднаквоста на граѓаните во општеството.

Третиот ден од обуката учесниците со обучувачката дискутираа за националната правна рамка и законските можности за користење на механизмите за заштита и спречување на дискриминација, при што беше утврдено дека граѓаните можат да се обратат до Народниот правобранител, Комисијата за спречување и заштита од дискриминација, суд и Уставниот суд на РСМ доколку им е загрозено некое право, а е поврзано со дискриминација по различен основ.

На крајот на обуката беа споделени и заклучоци од претходно наученото, па така беше утврдено дека:

  1. Дискриминацијата е присутна насекаде околу нас и обврска на сите е да се спротивставиме и залагаме за нејзино искоренување.
  2. Дискриминацијата може да биде спречена и да се заштитиме од истата, само доколку сме добро запознаени со нејзината суштина, нејзините видови и облици.
  3. Познавањето на законот од страна на граѓаните ќе доведе до негово активно користење во служба на заштита на правата на граѓаните.
  4. Институциите можат да ни помогнат само ако ние не се плашиме да ја споделиме нашата приказна и ги правиме сите можни законски напори за да издејствуваме правда и еднаквост помеѓу граѓаните.
  5. Дискриминацијата може да се сузбие само ако целосно и навремено ги користиме сите можни механизми за заштита.

In the period from 01-03rd of September 2021, was held the activity: “Promotion of the new Law on prevention and protection against discrimination and CSSD in cooperation with the Network for Protection against Discrimination”, entitled: “What and how much we know about discrimination”. The purpose of the activity was to introduce the participants to the basic concepts of discrimination, the new Law on Prevention and Protection against Discrimination and its implementation, as well as the protection mechanisms.

The training was attended by 18 participants (paralegals of LET Station, community promoters, as well as interested members of marginalized communities).

The training was held online on the Zoom platform, under the guidance of trainers Dragana Drndarevska and Natasha Boskova from the Coalition Margins and the Network for Protection against Discrimination.

On the first day of the training, participants had the opportunity to learn about the right to equality, legal definitions of discrimination, grounds for protection against discrimination and forms of discrimination through analysis of the national legal framework and discussion with specific examples of discrimination from participants’ daily experience. Participants also discussed ways of recognizing the types of discrimination (association by perception, multiple, repeated and prolonged / intersectional) and prevention versus protection against discrimination, exceptions to unequal treatment, and the burden of proof.

On the second day of the training, the emphasis was on understanding and recognizing intersectional discrimination, with special attention paid to marginalized communities (especially the Roma community and citizens living in rural areas). Together with the participants, definitions of racial and gender discrimination were made, which are one of the most common and most affected by the citizens. The training note that citizens often have problems recognizing these types of discrimination, which especially calls into question the equality of citizens in society.

On the third day of the training, the participants discussed with the trainer the national legal framework and the legal possibilities for using the mechanisms for protection and prevention of discrimination, and it was determined that the citizens can turn to the Ombudsman, the Commission for Prevention and Protection against Discrimination, court and The Constitutional Court of RSM if any of their rights are endangered, and it is related to discrimination on different grounds.

At the end of the training, were shared conclusions from the previously learned, so it was determined that:

  1. Discrimination is present everywhere around us and it is the duty of all to oppose and strive for its eradication.
  2. Discrimination can be prevented and protected from it only if we are well acquainted with its essence, its types and forms.
  3. Knowledge of the law by the citizens will lead to its active use in the service of protection of citizens’ rights.
  4. Institutions can only help us if we are not afraid to share our story and make every possible legal effort to achieve justice and equality among citizens.
  5. Discrimination can be suppressed only if we fully and timely use all possible protection mechanisms.
