Мрежата за заштита од дискриминација бара зголемување на Предлог-буџетот за Комисијата за спречување и заштита од дискриминација со што ќе се обезбеди нејзина функционална независност и непречено и сеопфатно функционирање, со цел грижа за маргинализираните граѓани

 

Владата на РСМ на 1 ноември 2021 ја информираше јавноста дека на 30 октомври го усвоила Предлог-буџетот за 2022 година и дека Предлог-законот за буџетот е доставен до Собранието на РСМ. Во Предлог-законот е испланиран речиси истиот буџет за Комисијата за спречување и заштита од дискриминација (КСЗД) споредено со 2021 година, кога во неговата подготовка не учествуваа претставници на КСЗД. Имено, усвоениот Предлог-буџет за КСЗД предвидува 15.320.000,00 денари, расчленети во неколку ставки. Особено загрижува тоа што во Предлог-буџетот не се испланирани средства за спроведување на активности од страна на КСЗД во насока на промовирање на принципот на еднаквост и ефективно спречување и заштита од дискриминација.

Мрежата за заштита од дискриминација потсетува дека во изминатиов период бевме сведоци на случаи на расно профилирање и полициска бруталност врз Роми, ограничување на пристапот до здравствена заштита, повикување и поттикнување дискриминација врз основа на сексуална ориентација и родов идентитет, кршење на правата на текстилните работнички и тн. Оттука, Мрежата за заштита од дискриминација цени дека функционалната независност на КСЗД треба да биде загарантирана, преку овозможување на соодветни финансиски ресурси за нејзино непречено и сеопфатно функционирање, што е потенцирано и од Европската комисија. Предвидениот буџет за КСЗД во Предлог-законот за буџетот на РСМ за 2022 година е манифестација на системската негрижа за најранливите групи граѓани. Малиот буџет кој не соодветствува на потребите и надлежностите на Комисијата, најмногу ќе се одрази на овие групи граѓани кои се најподложни на дискриминација.

Затоа, Мрежата за заштита од дискриминација бара изразување на политичка волја за дејствување во насока на унапредување на принципот на еднаквост со тоа што парламентарните претставници ќе го ревидираат Предлог-буџетот за КСЗД и ќе биде зголемен според потребите и надлежностите на КСЗД, а потоа и усвоен.

Оттука,

Во услови на бројни логистички и финансиски предизвици со кои се соочува КСЗД, Мрежата во неколку наврати повика на неопходноста од зголемување на буџетот преку објективни критериуми согласно надлежностите и соодветна поддршка од клучните институции. Токму нискиот буџет, недоволните и несоодветно распределените финансиски средства за остварување на надлежностите, ја загрозуваат самостојноста и независноста на Комисијата за спречување и заштита од дискриминација. Во крајна линија, ова значи дека на најмаргинализираните значително им се ограничува пристапот до ефективен заштитен механизам, а воедно и се зајакнува и одржува системската дискриминација во нашето општество.

The Network for Protection against Discrimination requests increase of the Draft-Budget for the Commission for Prevention and Protection against Discrimination, which will ensure its functional independence and smooth and comprehensive functioning, in order to take care of the marginalized citizens

The Government of RSM on November 1, 2021 informed the public that on October 30 it adopted the Draft Budget for 2022 and that the Draft Budget was submitted to the Parliament of RSM. The Draft-Law envisages almost the same budget for the Commission for Prevention and Protection against Discrimination (CSSD) compared to 2021, when representatives of the CSSD did not participate in its preparation. Namely, the adopted Draft-Budget for the CPD envisages 15,320,000.00 denars, broken down into several items. It is particularly worrying that the Draft Budget does not plan funds for the implementation of activities by the CPD in order to promote the principle of equality and effective prevention and protection against discrimination.

The Network for Protection against Discrimination reminds that in the past period we have witnessed cases of racial profiling and police brutality against Roma, restricting access to health care, invoking and inciting discrimination based on sexual orientation and gender identity, violation of textile workers’ rights and so-called Hence, the Network for Protection against Discrimination considers that the functional independence of the CPD should be guaranteed, by providing adequate financial resources for its smooth and comprehensive functioning, which is emphasized by the European Commission. The envisaged budget for the CPD in the Draft-Law on the Budget of RSM for 2022 is a manifestation of the systemic negligence for the most vulnerable groups of citizens. The small budget that does not correspond to the needs and competencies of the Commission, will mostly affect these groups of citizens who are most vulnerable to discrimination.

Therefore, the Network for Protection against Discrimination requires the expression of political will to act in order to promote the principle of equality by having the parliamentary representatives revise the Draft Budget for the CPD and increase it according to the needs and competencies of the CPD, and then adopt .

Hence,

In conditions of numerous logistical and financial challenges faced by the CPD, the Network has repeatedly called for the need to increase the budget through objective criteria in accordance with the competencies and adequate support from key institutions. It is the low budget, the insufficient and inadequately allocated financial resources for the realization of the competencies, that endanger the independence and independence of the Commission for Prevention and Protection against Discrimination. Ultimately, this means that the most marginalized are significantly restricted in their access to an effective protection mechanism, and at the same time the systemic discrimination in our society is strengthened and maintained.
